General conditions of sale

These General Conditions of Sale concern the purchase of Bax Italia srl ​​products carried out remotely via an electronic network on the website www.de-santis.it, belonging to Bax Italia srl, with headquarters in Naples, Via A. Scarlatti 160 - Naples - Italy - VAT number 06318380968. Each purchase transaction will be regulated by the provisions of the Legislative Decree. 185/99, Legislative Decree. 206/05; the information aimed at the conclusion of the contract will be subject to art. 12 of the Legislative Decree. 70/03 and, as regards the protection of confidentiality, it will be subject to the legislation referred to in Legislative Decree. 196/03.


Conclusion of the contract and acceptance of the general conditions of sale

The sales contracts for the products on the website www.de-santis.it are considered concluded when the purchase order placed by the customer is received by Bax Italia srl ​​and the latter accepts it. Bax Italia srl ​​will promptly send the customer a receipt of the purchase order placed by the customer.

By sending their purchase order electronically, the customer declares to have read and accepted these general contract conditions and undertakes to observe and respect them in his relationships with Bax Italia srl.

Personal data processing

Bax Italia srl ​​pursuant to art. 13 of Legislative Decree 196/2003 informs that the personal and fiscal data acquired even verbally in reference to established commercial relationships, provided directly by the interested parties, or otherwise acquired within the scope of the company's activity, will be processed in compliance with the aforementioned legislation , including the confidentiality obligations established by them
In relation to the aforementioned, the rights referred to in Article 7 of the Legislative Decree may be exercised. 196/2003.

Customer Obligations

The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance.
Finally, once the online purchase procedure has been completed, the Customer is required to print and keep these general conditions of sale, already viewed and accepted during the conclusion phase of the contract.


Order

By sending the online order, the Customer sends Bax Italia srl ​​a purchase proposal for the product and/or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.

 
Bax Italia srl ​​will communicate the acceptance and confirmation of the order to the Customer.

In particular, Bax Italia srl ​​will not accept orders:

  • if the material was not available in stock at the time of the order and/or
  • if the Customer cannot or does not want to pay using credit cards (Paypal), bank transfer.


PURCHASE METHOD

The customer purchases the product, the characteristics of which are illustrated online, at the price indicated therein to which the delivery costs specified on the site are added. (any costs for cash on delivery are excluded).

Before submitting the purchase order, the unit cost of each selected product, the overall cost in the case of purchasing multiple products and the related delivery costs are summarized.
Once the purchase order has been forwarded, the customer will receive an email from Bax Italia srl ​​confirming receipt of the purchase order and containing information relating to the main characteristics of the purchased good, a detailed indication of the price, of delivery costs, applicable taxes and means of payment and containing a reference to the general contract conditions and information regarding the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site. Following the approval of Legislative Decree 4 July 2006 n. 223 "bis maneuver" Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which came into force on 12 August 2006, which restores the obligation to communicate the list of customers and suppliers in the event of issue invoice, and Legislative Decree 78 of 31 May 2010 converted into Law 122 of 30 July 2010, imposes the need to request customers to communicate VAT NUMBER and TAX CODE in the appropriate fields on the site.


PAYMENT

The customer can make the payment due by choosing one of the following methods listed.

Payment by credit card: In the event that the consumer intends to make the payment by credit card, he can use the payment procedure with PayPal, suitable for ensuring the confidentiality of the data provided by customers. For any information and further Legal Agreements, the Customer is invited to consult the website www.paypal.com.

Payment by bank transfer


DELIVERY OF PRODUCTS

The purchased good, together with the relevant invoice, is delivered by courier to the address specified by the Customer when ordering online. Any specific needs must be presented by the customer to Bax Italia srl.

Bax Italia srl ​​guarantees delivery of the goods within 24/48 hours from the date of receipt of confirmation of the transaction.


GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS

The products purchased on the website www.de-santis.it are subject to the regulations on the sale of consumer goods. The products delivered comply with the characteristics illustrated online.

Bax Italia srl ​​is responsible towards the customer for defects in conformity existing at the time of delivery of the goods.


RIGHT OF WITHDRAWAL

The right of revocation is guaranteed only to consumers, i.e. natural persons acting for purposes unrelated to the entrepreneurial, commercial, artisanal or professional activity they may possibly carry out. Therefore, it is not possible to make use of this right if you are a professional, i.e. a person who operates in the context of your entrepreneurial, commercial, artisanal or professional activity, or if you act as an intermediary.
Deadline for requesting revocation.

You have a period of 14 (fourteen) days to request revocation starting from the date of receipt and/or delivery of the products or, in the case of services, from the conclusion of the contract. It is not necessary to provide a reason for the revocation request.

PRODUCT CHANGE COSTS

Product change costs.
The costs for changing the product are only for returning the product to our office.


RETURN COSTS

The costs for returning the product are the sole responsibility of the buyer, both for the return shipping and for the sale, if applicable and if they have not already been paid previously.

Purchased items must be returned in undamaged condition, without damage, in their original packaging and complete with all accessories and components included in the original packaging (such as locks, straps, wheels, instructions, guarantees, etc.).

Specific refund details

• For purchases made by bank transfer, de Santis will proceed with the refund by bank transfer.

• For purchases made by credit card, the refund will be made by canceling the transaction directly on the credit card.

• For purchases made via PayPal, the refund will be made via a credit to your PayPal account.
